Let Genarlow Wilson Out NOW

This is just such an outrageous miscarriage of justice I don’t know how to phrase my outrage.  The link is to a long and comprehensive article, but highly worth the read.  The guy did a stupid thing, like many kids do.  But would you want your 17-yr old to have to serve a 10 year sentence for this?  Regardless of how you feel about premarital sex and teen sex, it happens.  However, two items from the ESPN article linked above stick out like a sore thumb:

  • When he was a senior in high school, he received oral sex from a 10th grader. He was 17. She was 15. Everyone, including the girl and the prosecution, agreed she initiated the act. But because of an archaic Georgia law, it was a misdemeanor for teenagers less than three years apart to have sexual intercourse, but a felony for the same kids to have oral sex. (emphasis mine)
  • The position of (prosecutor) Barker and the district attorney, McDade, who refused to comment, is that Wilson is guilty under the law and there is no room for mercy, though the facts seem to say they simply chose not to give it to Wilson. At the same time this trial was under way, a local high school teacher, a white female, was found guilty of having a sexual relationship with a student — a true case of child molestation. The teacher received 90 days. Wilson received 3,650 days.

WTF? 

Why didn’t the court throw this out?  Why hasn’t the prosecutor been sacked?  Do you think he’d have been so adamant about “taking their medicine” if they had been white boys? 

IT’S EVEN ON VIDEO THAT THE GIRL WADDLED OVER TO HIM ON HER OWN FROM THE LAST GUY SHE FELLATED.  Do you honestly expect a teenage boy to say NO to a girl that’s almost his age?  If you do, contact me about some bridges I need to sell.

Think of it this way: what’s the age difference between your parents?  It’s 3 years between mine, and evidently it only takes two. 

This is an unbelievable miscarriage of justice, if not a deliberate act of injustice, and needs to be rectified immediately.  Hey, Congress, you were so concerned with sticking your nose in the Schiavo case, how about this one?  Where NO ONE except a prosecutor with an attitude wants this boy to serve the best years of his life behind bars for what seems like a common teenage act!

  1. See, now, if Cannick wants to play a race card, this is the game she should be trying to get dealt into. Wilson should be freed and David McDade should share a prison cell with Mike Nifong. The people of Georgia should be incensed that this is how their tax dollars are being spent.

    When an article that revolves around invoking consent makes a comparison, but refuses to give the age of the participants, be careful.

    A high school teacher in Douglas County is accused of carrying on a sexual relationship with a 16-year-old male student.

    Having sex with a 16-year-old male in Georgia is not by any legal definition child molestation, since the age of consent is 16 — and, since he CAN consent to it, rape isn’t even a question in that event. In short, ESPN is trying to make two things that aren’t seem similar so they can claim racial discrimination — even if they must cover up the facts of the other case to do it.

    Do you honestly expect a teenage boy to say NO to a girl that’s almost his age? If you do, contact me about some bridges I need to sell.

    Then send me your real estate prospectus. Yes, I do, and I don’t think it’s asking too much to do it. This kid is old enough to drive a car, old enough to get chewed out for missing a snap count, old enough to keep control of himself on the football field when emotions are running high, and old enough to come in for curfew, but he’s too immature to keep his privates in his pants and say no?

    But would you want your 17-yr old to have to serve a 10 year sentence for this?

    No. But if my seventeen-year-old did something like this after I specifically told them not to do anything stupid, I think they’ve made the decision to disobey me and the law; the consequences then take over.

    I mean, look at this.

    Genarlow Wilson and his friends checked into the Days Inn right off Interstate 20. At some point in the night, according to court documents and evidence presented at trial, some girls came over to party with them. Bourbon and marijuana were consumed. One of the young men turned on a video camera.

    Later in the evening, a 17-year-old girl began to have sex with the young men, first in the bathroom, then on the bed. Genarlow is captured on tape appearing to have sex with the girl from behind. Her hand is clearly visible on the floor supporting herself. Witnesses said she was a willing participant.

    The next morning, the girl awoke in a stupor, wearing nothing but her socks. She called her mother and said she had been raped. Police came to the room after sunrise and took the revelers in for questioning. Genarlow had already gone home — he didn’t want to miss curfew — but the video camera remained.

    On tape, the cops saw a 15-year-old girl, a 10th-grader, performing oral sex on a partygoer and, after finishing with him, turning and performing the act on Genarlow. She was the instigator, according to her mother’s testimony. Problem was, the girl was a year under the age of consent.

    So let’s see. Drugs. Underage drinking. Sex with minors under the age of consent. All on tape, for whatever idiot reason, which is skirting pornography and child-porn laws at best. And, better yet, every last bit of it seems to have been premeditated.

    You’re right that this was a horrible waste, Jamie. But it’s not the police’s fault, not the prosecutor’s fault, not anyone else’s fault. It’s Genarlow’s fault. He chose to be there. He chose to participate. He knew it was wrong, and he did it anyway — and then he chose not to take the plea bargain.

    And finally this:

    Two years.

    But amazingly enough, they waited until they were nineteen and twenty-one, respectively, to have sex — after they were married. And they’re now in the middle of their third decade together.

    I can understand this story. It’s a frightened kid, a liberal lawyer, and a publication that is desperate for ratings — all of which leads to covering up facts, playing the race card, and insinuating that Georgia is “unfair” for sentencing someone who chose to risk a jury trial and was found guilty according to their laws.

    But that doesn’t make what they’re trying to do right.
